DMCA Policy

Nova Luxxe respects the intellectual property rights of others and expects users of novaluxxe.com to do the same. This policy explains how to report claimed copyright infringement under the Digital Millennium Copyright Act ("DMCA").
1. Filing a takedown notice
If you believe content on the Site infringes your copyright, send a written notice to our designated agent (below) that includes:
- A physical or electronic signature of the copyright owner or person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material you claim is infringing, with enough detail (such as a URL) for us to locate it on the Site
- Your contact information — address, telephone number, and email address
- A statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

3. Counter-notification
If you believe content we removed (or disabled) is not actually infringing, or that you have authorization to post it, you may send us a counter-notice containing:
- Your physical or electronic signature
- Identification of the material removed and its location on the Site before removal
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., an appropriate judicial district), and that you'll accept service of process from the person who filed the original takedown notice
Upon receiving a valid counter-notice, we may restore the removed content within the timeframe required by law, unless the original complainant files a court action seeking to restrain the alleged infringer.
4. Repeat infringer policy
We may suspend or terminate the accounts of users determined, in our judgment, to be repeat infringers.
5. Misrepresentation
Submitting a false or bad-faith DMCA notice or counter-notice may expose you to liability for damages under applicable law.
